By registering with BookingReady.com ("Site", "BookingReady") and by signing up for the BookingReady service ("Service") indicates that you accept these Terms as being the basis of the agreement between BookingReady ("BR", "Us", "We") and you ("You") covering use of the website creation and maintenance functions and facilities ("Product, Services") contained with the Site and you agree to be bound by these Terms.
BookingReady reserves the right to update and change the Terms of Service at their discretion. Any new features or tools which are added to the current Service shall be also subject to the Terms of Service. You can review the most current version of the Terms of Service at any time at: https://www.bookingready.com/terms-of-service. You are advised to check the Terms of Service from time to time for any updates or changes that may impact you.
BookingReady online service ("Service" or "Services") provides fully functional template- or custom-based websites, website development and hosting services.You may use the Service for your personal and business use or for internal business purpose in the organization that you represent, but only on a web server hosted and controlled by BookingReady.
You may connect to the Service using any Internet browser. You are responsible for obtaining access to the Internet and the equipments necessary to use the Service. You can create and edit content with your user account and if you choose to do so, you can publish and share such content.
As part of the Service, BookingReady may provide you with domain name search and registration services, custom designing services, custom development work, website maintenance and hosting, and other ordered by You under your subscription or order form.
You must be 16 years or older to use this Service. You must provide your full legal name, a valid email address, and any other information needed in order to complete the signup process. You are responsible for all information, data, text, messages or other materials that You post or otherwise transmit via the Service. You are responsible for maintaining the confidentiality of your login and account and are fully responsible for any and all activities that occur under your login or account.
You agree and acknowledge that your login may only be used by one (1) person - a single login shared by multiple people is not permitted and constitutes a violation of the TOS. You may create separate logins for as many people as your plan allows. Tokeet reserves the right to access any or all your accounts in order to respond to your requests for customer support.
You are responsible for all activity and content (data, links) that is uploaded under your BookingReady account.You may not use the BookingReady service for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws) as well as the laws of United States.
You acknowledge that this TOS is a contract between You and BookingReady, even though it is electronic and is not physically signed by you and BookingsReaedy, and it governs your use of the Service and takes the place of any prior agreements between You and BookingReady. BookingReady reserves the right to terminate your access to the Services at our sole discretion, without notice, if there are reasonable grounds to believe that you have used the Services for any illegal or unauthorized activity.
All property listings on the Site are the solely represented by the Member and we specifically disclaim any and all liability arising from the alleged affiliations between BookingReady and the property listings. Users are solely responsible for keeping their personal and property information up-to-date on the Site, including, but not limited to any and all representations about any property, its amenities, location, price, and its availability for a specific date or range of dates. We do not represent or warrant that any of the copy, content, property reviews, property location, suitability, pricing or availability information published on the Site is accurate or up-to-date even in the case where prospective renters have searched for specific special offers, dates, or types of properties.
Geographic locations of listings are automatically generated with Google Maps API. Members are solely responsible for ensuring the accuracy of location, geographic and other content and location or geographic descriptions and agree to promptly correct any inaccuracy, and renters are solely responsible for verifying the accuracy of such content and descriptions.
By uploading content to BookingReady.com, you agree to allow other internet users to view them and you agree to allow BookingReady to display and store them and you agree that the Company can, at any time, review all the content submitted by you to its Service. You retain ownership over all content that you submit to a BookingReady account however, by making your bookings public, you agree to allow others to view your bookings dates and status.
The Service may include certain communications from BookingReady, such as service announcements, administrative messages and newsletters. You understand that these communications shall be considered part of using the Service. As part of our policy to provide you total privacy, we also provide you the option of opting out from receiving news from us. However, you will not be able to opt-out from receiving administrative messages.
We regularly examine customer bandwidth and disk space utilization data in a series of statistical analyses and use the results to define 'normal average usage' for Your subscription plan. BookingReady will use reasonable efforts to notify you when the monthly usage reaches approximately 80% of the average data limits. If you continuously exceed the 'normal average usage' usage you will need to optimize your data or additional charges may occur.
You acknowledge and understand that NowRenting uses third party vendors to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
You acknowledge and understand that BookingReady Free account is supported by advertising, enabling BookingReady to provide its services to you at no cost. When you use these free services, you agree to allow BookingReady to display advertising, including third party advertising, through the Products and Services.
Technical support is only provided to paying account holders and is only available via email. Questions about the Terms of Service should be sent to support@bookingready.com
Verbal, physical, written or other abuse (including threats of abuse or retribution) of any BookingReady employee, member, or officer will result in immediate account termination and potential criminal charges.
The basic features of the Service (referred to as the Free Plan) is offered free of charge, or any other costs, to You. BookingReady offers additional Plans to You at a specified cost. These additional Plans are optional and will not affect your use of the Free Plan if You choose not to purchase them. BookingReady reserves the right to add features to the Free Plan or change the Free Plan without prior notice, but will do its best to keep You updated and informed of any changes. BuukingsReady also reserves the right to add or remove additional Paid Plans, change the configuration of all Plans, or stop offering any Plan at its discretion and without prior notice. BookingReady will, however, do its very best to keep You informed and prepare for any of these changes.
No credit card or payment is required for the Free Plan. A valid credit card is required for paying accounts. Upgrading from the free plan to any paying plan will effectively end your free trial. When you upgrade, you will be billed for your first month immediately.
The Service will be billed by month intervals. When your billing period is over BookingReady users will be sent an invoice via email. As well, an invoice will appear on the account page of your BookingReady administration console. Users have approximately two weeks to bring up and settle any issues with the billing.
The Company does not provide refunds.
You may cancel your account at anytime by emailing support@bookingready.com . Once your account is canceled all of your Content will be immediately deleted from the Service. Since deletion of all data is final please be sure that you do in fact want to cancel your account before doing so.
Termination of your account will include denial of access to website administration, canceling of your hosting, deletion all your data (such as Customer Data, password, usernames and any data related to your account) after 30 days of the termination.If you cancel the Service in the middle of the month, you will receive one final invoice via email. Once that invoice has been paid you will not be charged again.
Without limiting any other remedies, the Company may suspend or terminate your account if we suspect that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with the Site.The Company does not warrant that the service will be uninterrupted, timely, secure, or error-free. You expressly understand and agree that the Company shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the service.
YOU AGREE AND ACKNOWLEDGE THAT, THE ENTIRE RISK ARISING OUT OF YOUR ACCESS TO AND USE OF THE SITE, APPLICATION, SERVICES, CONTENT AND USER GENERATED CONTENT, LISTING OF ANY PROPERTY, AND ANY CONTACT, LEASES, OR AGREEMENTS YOU MAKE OR SIGN WITH OTHER USERS OF BookingReady, WHETHER ONLINE OR IN PERSON SOLELY REMAINS WITH YOU. NEITHER BookingReady NOR ANY OTHER THIRD-PARTY ASSOCIATED WITH THIS SITE WILL BE LIABLE FOR ANY INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, SERVICE INTERRUPTION, COMPUTER DAMAGE OR SYSTEM FAILURE OR THE COST OF SUBSTITUTE PRODUCTS OR SERVICES, OR FOR ANY DAMAGES FOR PERSONAL OR BODILY INJURY OR EMOTIONAL DISTRESS ARISING OUT OF OR IN CONNECTION WITH THIS SITE, FROM THE USE OF OR INABILITY TO USE THE SITE, APPLICATION, SERVICES OR CONTENT OR USER GENERATE CONTENT, FROM ANY COMMUNICATIONS, INTERACTIONS OR MEETINGS WITH OTHER USERS OF THE SITE OR OTHER PERSONS WITH WHOM YOU COMMUNICATE OR INTERACT AS A RESULT OF YOUR USE OF THE SITE, OR AGREEMENTS MADE OR SIGNED WITH USER OF THIS SITE, OR OTHER PERSONS WITH WHOM YOU MAY INTERACT AS A RESULT OF YOUR USE OF THIS SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, NEGLIGENCE, PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT BookingReady HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A PRODUCT OR SERVICE OFFERED BY THIS SITE HAS FAILED OF ITS ESSENTIAL PURPOSE.
THE SERVICE, INCLUDING THE SITE AND CONTENT, AND ALL SERVER AND NETWORK COMPONENTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, TO THE FULLEST EXTENT PERMITTED BY LAW AND BookingReady EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOU ACKNOWLEDGE THAT BookingReady DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE OR VIRUS-FREE AND NO INFORMATION OR ADVICE OBTAINED BY YOU FROM BookingReady OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS TOS.
The failure of either party to enforce any provision of this Contract shall not be construed as a waiver or limitation of that party’s right to subsequently enforce and compel strict compliance with every provision of this Contract.
